For undisputed commercial debts, Spain's monitorio is among the most cost-effective enforcement instruments in Europe.
Spanish debt collection law operates under the Código Civil, the Ley de Enjuiciamiento Civil (LEC), and the Ley 3/2004 de Medidas de Lucha contra la Morosidad. Statutory interest on commercial debts is set at the BCE reference rate plus 8 percentage points, accruing automatically from the day after the contractual due date.

The Burofax is Spain's standard instrument for formal legal notification. Issued through Correos, it provides certificated proof of content and delivery — legally equivalent to a notarial notification. The debtor cannot claim ignorance.
The Proceso Monitorio under Articles 812–818 LEC is Spain's primary instrument for debt collection. The debtor has 20 days to pay or oppose. If the debtor does nothing, the LAJ issues a Decreto de Ejecución automatically.

When the debtor opposes the Monitorio, Spanish law provides two standard procedures: Juicio Verbal for claims up to EUR 6,000 (3–6 months) and Juicio Ordinario for claims above EUR 6,000 (8–14 months). Spanish courts have made significant progress in reducing backlogs through the Lexnet electronic filing system.
