The UAE is a dual-system jurisdiction โ€” onshore federal courts operating under civil law, and offshore financial centre courts (DIFC and ADGM) operating under English common law.

    The Onshore Legal System

    The UAE's onshore legal framework is governed by Federal Law No. 5/1985 (Civil Transactions Law), Federal Decree-Law No. 50/2022 (Commercial Transactions Law), and Federal Decree-Law No. 42/2022 (Civil Procedures Law). Courts operate in Arabic, require all submissions in Arabic, and follow a civil law procedural model.

    DIFC and ADGM Courts: The Common-Law Alternative

    The DIFC Courts and ADGM Courts operate as independent common-law jurisdictions within the UAE. Proceedings are in English, governed by common-law principles, and presided over by internationally recruited judges. The DIFC Small Claims Tribunal handles claims up to AED 500,000.

    Interim Measures: Travel Bans and Asset Freezes

    UAE courts can issue a Precautionary Attachment (Hajz Tahafu'zi) to freeze bank accounts before judgement, and a Travel Ban (Man' Min Al Safar) to prevent the debtor from leaving. These are available at the outset of proceedings, even ex parte in urgent cases.

    Enforcement of Foreign Judgements
