    The Legal Framework

    German debt collection law operates under the Bürgerliches Gesetzbuch (BGB — Civil Code) and the Zivilprozessordnung (ZPO — Code of Civil Procedure). Commercial interest accrues automatically at 9 percentage points above the ECB base rate for commercial debts under § 288 BGB — one of the highest statutory rates in the EU. This interest runs from the day after the payment deadline, without any need for a formal notice of default (Mahnung), provided the due date was contractually fixed. If the due date was not fixed, a Mahnung is required under § 286 BGB to trigger default.

    The Kontopfändung is the most effective tool for commercial claims. The Vollstreckungsgericht issues the order, which is served on the debtor's bank, freezing the account immediately. Corporate debtors have no Pfändungsschutzkonto protection — the entire account is frozen.

    Vermögensauskunft: The Debtor's Disclosure Obligation

    If enforcement produces no result, the creditor can compel the debtor to provide a Vermögensauskunft (asset disclosure) under § 802c ZPO — a sworn statement of all assets, income, and financial positions. Failure to comply results in a Haftbefehl (arrest warrant). The Vermögensauskunft is also registered in the Schuldnerverzeichnis (debtor register), visible to credit agencies and business partners. This registry entry follows the debtor for three years.
