The United Arab Emirates is the commercial gateway to the Gulf, the Middle East, and North Africa. It is also one of the most misunderstood jurisdictions in international debt collection. The UAE is a dual-system jurisdiction โ onshore federal courts operating under civil law, and offshore financial centre courts (DIFC and ADGM) operating under English common law.
The UAE's onshore legal framework is governed by Federal Law No. 5/1985 (Civil Transactions Law), Federal Decree-Law No. 50/2022 (Commercial Transactions Law), and Federal Decree-Law No. 42/2022 (Civil Procedures Law). Courts operate in Arabic, require all submissions in Arabic, and follow a civil law procedural model.

The Payment Order procedure under Articles 143-148 of the Civil Procedures Law provides a fast-track mechanism for undisputed debts. The court reviews the application ex parte and issues an order within days. This procedure is underutilised by foreign creditors and is one of the most effective tools available.
The DIFC Courts and ADGM Courts operate as independent common-law jurisdictions within the UAE. Proceedings are in English, governed by common-law principles, and presided over by internationally recruited judges. The DIFC Small Claims Tribunal handles claims up to AED 500,000.
