German Mahnverfahren Payment Order: The EUR 32 Legal Door (And What It Actually Costs Now)
Your German debtor has discovered the ancient art of not replying to emails. Time to introduce them to the Mahngericht. The Mahnverfahren is a streamlined court procedure under §§ 688-703d of the Zivilprozessordnung that issues a formal payment order without a hearing, and if the debtor stays silent, you get an enforceable title in about four to six weeks for a minimum court fee of EUR 38.
| Key Fact | Detail |
|---|---|
| Legal basis | §§ 688-703d ZPO, Book 7 |

If you are sitting on a German invoice that has stopped answering the phone, you already know the polite escalation ladder ran out of rungs. What you need now is the cheapest lawful way to turn that invoice into a court title you can enforce against bank accounts, wages, and assets. This article walks you through the fee history nobody else bothers to track, the venue rule most foreign creditors get wrong, and the opposition mechanics that decide whether you finish in six weeks or eighteen months.
How Much Does a Mahnbescheid Cost?
The Mahnverfahren court fee is set by KV 1100 of the Gerichtskostengesetz Kostenverzeichnis as a 0.5 Gebühr on the Streitwert, with a statutory floor of EUR 38.00 since 1 June 2025. EUR 38 is not a typo. That really is what the court charges you to initiate a payment order against a German company, regardless of whether the invoice is for EUR 5,000 or EUR 50,000 (the minimum applies until the proportional 0.5 Gebühr calculation exceeds it).
For larger claims the fee scales. A Streitwert of EUR 10,000 triggers a court fee of roughly EUR 121.50. A claim of EUR 100,000 runs approximately EUR 546. You pay the fee upfront with the application (§ 12 GKG). If the debtor is ordered to pay, the fee is recoverable as part of the Kostenfestsetzung.
How Long Does the German Mahnverfahren Take?
If the debtor does not oppose, a Vollstreckungsbescheid (enforcement order) can issue within roughly four to six weeks of filing. The court issues the Mahnbescheid within days of receiving a clean application, the debtor has two weeks to file Widerspruch after service, and if silence prevails the creditor requests the Vollstreckungsbescheid, which grants another two-week Einspruch window before it becomes final.
Contested matters take longer because the case converts automatically. Once the debtor files Widerspruch under § 696 ZPO or Einspruch under § 700 Abs. 3 ZPO, the file transfers ex lege to the competent trial court and you are in streitiges Verfahren territory. Expect six to eighteen months from that point, depending on docket and complexity.
Can a Foreign Creditor File a Mahnbescheid in Germany?
Yes, and § 703d ZPO tells you exactly which court to use. When the debtor has a general German forum the Mahnantrag goes to the Mahngericht for that forum. When the debtor has no general German forum, § 703d ZPO designates the Amtsgericht Berlin-Wedding as the exclusive central Mahngericht. This is the single venue that catches claims against German debtors with no domestic forum, against foreign-domiciled debtors where enforcement is permitted, and against defendants whose residence is not fixed.
The § 688 Abs. 3 ZPO restriction matters here. The Mahnverfahren against a foreign-domiciled debtor is only available where the Anerkennungs- und Vollstreckungsausführungsgesetz provides for enforcement in the debtor's state, which in practice means EU Member States and a short list of treaty jurisdictions. For non-treaty countries you use the European Order for Payment or go straight to litigation.
What Happens If the Debtor Opposes the Mahnbescheid?
On Widerspruch the case does not collapse. Under § 696 ZPO the matter transfers automatically to the competent trial court once the creditor or debtor pays the remaining court fees to top up to a full litigation fee. The Mahnverfahren costs do not disappear either; they are credited against the trial costs. The two-week opposition window sounds short until you remember that most debtors who were going to oppose have already been opposing by email for three months.
Einspruch against the Vollstreckungsbescheid works similarly under § 700 Abs. 3 ZPO. The file transfers to trial court, but the Vollstreckungsbescheid remains provisionally enforceable pending the outcome, which means you can still seize while the litigation runs. That asymmetry is one of the most underrated features of the German system.
The Real Court Fee: EUR 32, EUR 36, EUR 38 and Why Most Articles Get It Wrong
The Mahnverfahren was once Europe's cheapest legal door at EUR 32. Even after the 2025 reform to EUR 38, it still is. The KV 1100 GKG minimum has moved exactly twice in recent memory:
- Pre-2021: EUR 32.00 (the figure most English-language legal blogs still quote)
- 1 January 2021: EUR 36.00 (Kostenrechtsänderungsgesetz 2021)
- 1 June 2025: EUR 38.00 (Kostenrechtsänderungsgesetz 2025, KostRÄG 2025)
The 2025 reform raised the floor by two euros, which is not going to change your litigation strategy but will absolutely expose any advisor still quoting pre-2021 numbers. If your German counsel is still telling you the payment order costs EUR 32, ask them when they last opened the Kostenverzeichnis. The current KV 1100 minimum is EUR 38, and it has been since 1 June 2025.
When a Mahnverfahren Is Not For You
- Unliquidated or non-monetary claims. § 688 Abs. 2 ZPO requires a specific sum in euros. Damages requiring judicial assessment, delivery obligations, and performance claims do not qualify.
- Debtors in non-treaty jurisdictions. § 688 Abs. 3 ZPO shuts the door when AVAG enforcement is not available in the debtor's state of domicile.
- Claims you expect to be contested on the merits. If the debtor has a real defence they will file Widerspruch on day one and you have just paid a court fee to arrive at the same trial court you could have filed in directly.
- Consumer credit claims with interest above the legal cap. The Mahngericht plausibility check will reject applications that exceed § 688 Abs. 2 Nr. 1 ZPO interest limits.
How InterStation Handles a German Claim
- Jurisdiction and venue diagnosis. We confirm whether § 703d ZPO routes the matter to Amtsgericht Berlin-Wedding or to a forum-specific Mahngericht, and whether § 688 Abs. 3 ZPO permits the procedure at all.
- Pre-Mahnverfahren demand. A formal letter on InterStation letterhead referencing the ZPO timeline resolves a meaningful share of files before any court fee is paid. Debtors who ignored you may read us.
- Electronic filing via EGVP. Lawyers and Inkassounternehmen must file electronically. We submit through the online-mahnantrag.de portal with plausibility checks cleared, which eliminates the rejection loop that eats weeks for first-time foreign filers.
- Service monitoring and title capture. We track the Mahnbescheid service date, calendar the two-week Widerspruch window, and request the Vollstreckungsbescheid the moment it is available.
- Enforcement or conversion. If the title is clean we move to Zwangsvollstreckung against accounts, receivables and movables. If the debtor opposes we hand the file to German litigation counsel with a complete pre-trial record.
