Debt collection in Spain

Spanish commercial law provides the procedimiento monitorio — a fast-track payment order with no upper claim limit and minimal court fees. It is devastatingly effective. If Spanish debtors knew how easy it is to use, they would pay their invoices on time.

  • Collection Rate: 84%
  • Avg Days: 42d
  • Legal System: Civil law
  • Currency: EUR
  • Language: Spanish

Spain is the eurozone's fourth-largest economy and a jurisdiction that offers creditors one significant advantage: the Proceso Monitorio — a payment order procedure with no court fees for claims under EUR 250,000 and no upper claim limit. For undisputed commercial debts, Spain's monitorio is among the most cost-effective enforcement instruments in Europe.

The Legal Framework

Spanish debt collection law operates under the Código Civil, the Ley de Enjuiciamiento Civil (LEC), and the Ley 3/2004 de Medidas de Lucha contra la Morosidad. Statutory interest on commercial debts is set at the BCE reference rate plus 8 percentage points, accruing automatically from the day after the contractual due date.

Ley 3/2004 · Artículos 812-818 LEC

Statutory interest at ECB + 8%. EUR 40 minimum collection costs per invoice. Proceso Monitorio: no court fees for claims under EUR 2,000. No upper claim limit.

Pre-Litigation: The Burofax

The Burofax is Spain's standard instrument for formal legal notification. Issued through Correos, it provides certificated proof of content and delivery — legally equivalent to a notarial notification. The debtor cannot claim ignorance.

The Proceso Monitorio: Spain's Free Payment Order

The Proceso Monitorio under Articles 812–818 LEC is Spain's primary instrument for debt collection. The debtor has 20 days to pay or oppose. If the debtor does nothing, the LAJ issues a Decreto de Ejecución automatically.

  1. Certified legal notice — Issued via Correos. Certified proof of content and delivery. The debtor cannot claim ignorance.
  2. Payment order (free) — No court fees under EUR 2K. No upper limit. 20 days to pay or oppose. No hearing needed.
  3. Full proceedings — Claims above EUR 6K if opposed. Demanda, Contestación, trial. 8-14 months.
  4. Asset seizure — Electronic bank seizure via Punto Neutro Judicial. Property registered at Registro de la Propiedad.

Court Proceedings: Juicio Ordinario and Juicio Verbal

When the debtor opposes the Monitorio, Spanish law provides two standard procedures: Juicio Verbal for claims up to EUR 6,000 (3–6 months) and Juicio Ordinario for claims above EUR 6,000 (8–14 months). Spanish courts have made significant progress in reducing backlogs through the Lexnet electronic filing system.

Enforcement: Ejecución and Embargo

Spanish enforcement begins with a Demanda Ejecutiva. The primary tool is the Embargo de Bienes, which follows a statutory priority order: cash and bank deposits first, then financial instruments, receivables, movable assets, then real property. Bank account seizure through the Punto Neutro Judicial is electronic and immediate.

The Proceso Monitorio has no upper claim limit. Claims of EUR 1 million or EUR 10 million can be filed through the Monitorio, provided the debt is documented, determined, due, and payable. One of the most powerful payment order systems in the EU.

The Concurso de Acreedores: Spanish Insolvency

The Pre-Concurso allows debtors to notify the court of their intention to negotiate, triggering a 3-month moratorium on enforcement. This provision is frequently used as a tactical delay mechanism. Early detection through the Registro Público Concursal is essential.

  • Punto Neutro Judicial — Electronic bank seizure — the court system connects directly to Spanish banks.
  • Registro de la Propiedad — Property charge prevents sale without satisfying the debt.
  • Subasta Electrónica — Forced sale via online auction platform.
  • Pre-Concurso detection — We monitor the Registro Público Concursal for tactical delay filings.
