The challenge for foreign creditors is navigating the system. German debt collection law operates under the Bürgerliches Gesetzbuch (BGB) and the Zivilprozessordnung (ZPO). Interest accrues automatically at 9 percentage points above the ECB base rate for commercial debts under §288 BGB. The Mahnverfahren (automated payment order procedure) is filed electronically through centralised courts and costs as little as EUR 32.     Phase 1 — Amicable Demand

    Formal Mahnung (payment reminder) issued in German, referencing §286 BGB (debtor default) and §288 BGB (statutory interest). Phone contact from our German-speaking team. Most debtors respond within 14 days.

    Phase 2 — Mahnbescheid (Payment Order)

    Filed electronically with the Amtsgericht. Cost: EUR 32 for claims up to EUR 50,000. The debtor has 14 days to object. No objection = enforceable title. No hearing. No lawyer required at this stage.

    Phase 3 — Vollstreckung (Enforcement)

    Vollstreckungsbescheid (enforcement order) issued. Gerichtsvollzieher (bailiff) instructed. Bank account seizure (Kontopfändung). Wage garnishment (Lohnpfändung). Asset attachment. The debtor’s options narrow rapidly.

    The Mahnbescheid is Germany’s most cost-effective collection instrument. No hearing, no lawyer fee, no courtroom. The debtor either pays, objects (and faces a full court claim), or stays silent (and loses). Most debtors choose to pay.

    The German legal system rewards early action. Limitation periods for commercial claims run at 3 years from the end of the year the claim arose (§195 BGB). Once that window closes, enforcement becomes significantly harder. German debtors know this — which is why delay is their primary tactic.
