JURISDICTION FILE
English commercial law is creditor-friendly by design. The Pre-Action Protocol sets clear expectations. The County Court or High Court follows if those expectations are not met. Statutory interest at base rate plus 8%. The system works โ if you know how to use it.
The United Kingdom operates under common law โ a system that favours documented claims and procedural compliance. The Civil Procedure Rules (CPR) require creditors to follow a Pre-Action Protocol before issuing court proceedings: a formal Letter Before Action (LBA) giving the debtor 14-30 days to respond. This is not a courtesy โ it is a procedural requirement. Failure to comply can result in costs penalties even if you win. InterStationโs London office โ at 128 City Road, EC1V 2NX โ is the operational headquarters for UK collection. We issue Letters Before Action daily, file County Court claims through Money Claims Online (MCOL), and instruct High Court Enforcement Officers for claims over GBP 600. UK debt collection is our home jurisdiction.
HOW WE COLLECT HERE
Formal pre-action demand under CPR Practice Direction โ Pre-Action Conduct. Specifies the debt, interest accrued, and intention to issue court proceedings. 14-30 day response period. This letter alone resolves approximately 40% of UK cases.
Claim filed through Money Claims Online (MCOL) for debts up to GBP 100,000 or Part 7 claim for larger amounts. If undefended: default judgment in 14 days. The CCJ is registered on the debtorโs credit file for 6 years โ a powerful incentive to settle.
For judgments over GBP 600, enforcement transfers to the High Court. High Court Enforcement Officers (HCEOs) attend the debtorโs premises with authority to seize goods. Collection rates via HCEO are significantly higher than County Court bailiffs.
LEGAL INSTRUMENT SPOTLIGHT
Pre-Action Protocol + CPR Part 7/Part 24
UK commercial collection benefits from one of the worldโs most transparent corporate registries. Companies House data is publicly available and updated regularly โ registered directors, filed accounts, confirmation statements, charges, and insolvency history. InterStation uses this data as the foundation of every UK debtor profile. We also monitor the Gazette for winding-up petitions and statutory demands served on debtors. A CCJ registered against a UK company affects its credit rating, its ability to secure financing, and its reputation with suppliers. Many UK debtors pay at the LBA stage specifically to avoid a CCJ. We rely on this dynamic.
